Essentially, a lender has two means at his or her disposal for recovering his or her investment: payment or seizure.
In most cases, payment is the preferred method. We will carefully review the situation to determine options for obtaining payment. In Chapter 11 cases, a business may be required to liquidate certain assets in order to pay off creditors. Frequently, a business may attempt to preferentially pay another lender instead of you. Seizure of property, also known as repossession, is the other means of recovering your interests from a debtor. You may have the right to repossess the collateral. We will work with you to see that the proper process is followed when attempting repossession of property.
